RIGHT TO BE FORGOTTEN: LAW TO BE REGULATED BY THE END OF 2025

Legislation facilitating access to mortgage loans for people who have overcome serious illnesses has yet to be put into practice.
Three years ago, Parliament passed the right to be forgotten law to facilitate access to mortgage loans and insurance for people who have overcome serious illnesses. However, the regulations for this law have not yet seen the light of day, making its practical application difficult. Now, the government guarantees that the right to be forgotten law will be regulated by the end of 2025.

The regulation of the right to be forgotten law is expected to start in January 2025 and will have a team that brings together efforts from the Ministry of Youth and Modernization, the Secretary of State for the Treasury and Finance, and the Secretary of State for Health, which also involves the Insurance and Pension Funds Supervisory Authority (ASF) and the Directorate-General for Health (DGS), writes Público.

The government expects the regulations for this law to be finalized by the end of the year to improve access to mortgage loans and insurance contracts for people who have overcome serious health risks, establishing the right to be forgotten. This law also prohibits discriminatory practices, ensuring that people cannot be subject to increased insurance premiums and/or exclusion from insurance contract guarantees and that health information relating to the medical condition that gave rise to the aggravated health risk or disability cannot be collected once certain time limits have elapsed.

The main objective of the Executive is to create “a reference grid to define the terms and deadlines of this right to be forgotten,” explained Margarida Balseiro Lopes, Minister of Youth and Modernization, to the same newspaper, confirming that the regulation will “clarify which pathologies are covered and how the law can be applied by the authorities.”
