As of Thursday (January 10, 2019), landlords will have access to more IRS tax benefits depending on the length of their rental contracts, as well as access to incentives in affordable housing construction programs.
The law, now published in Diário da República, stipulates that for a contract of more than two years, the IRS rate will be reduced by 2% to 26%. For five-year contracts, the reduction is 5%, to 23%. And there are two more tax brackets: for contracts between 10 and 20 years a rate of 14% will be applied, while for contracts over 20 years a rate of 10% will be applied.
The law also authorizes the creation of the Affordable Rent Programme, under which landlords will be able to benefit from a total exemption from property tax, IRS and Corporate Income Tax (IRC), as long as the rent is less than 20% of market prices and tenants do not have to bear an effort rate of more than 35%.
